1. Agreement to these terms
These terms are a contract between you and Forge Nova Labs (“we,” “us”) governing your use of ArcForge, including the public website, the signed-in application, and all content and features within them (together, the “Service”). By creating an account or using the Service you agree to these terms and to our Privacy Policy. If you use the Service on behalf of a school or organization, you represent that you are authorized to bind it.
2. The Service is educational
ArcForge is an educational tool. Nothing in the Service — including AI analysis results, practice scores, lessons, certification-prep content, or quiz results — constitutes weld inspection, engineering judgment, code-compliance determination, qualification, or certification of any kind.
- AI analysis describes the visible surface of a photograph. It cannot and does not confirm code compliance, structural integrity, internal fusion, penetration, or test outcomes.
- Certification-prep content is independent study material. We are not affiliated with, endorsed by, or approved by AWS, ASME, API, OSHA, or any certification organization, and completing content grants no certification or qualification.
- Decisions about weld acceptability, structural use, or test readiness must be made by qualified people — instructors, inspectors, and accredited testing facilities.

3. Eligibility and accounts
You must be at least 13 years old (or the minimum age in your jurisdiction) to create an account; school-enrolled minors require their school to handle any consents the law requires. You are responsible for your credentials and for activity on your account. Provide accurate information and keep it current.
4. Subscriptions, billing, and allowances
- Paid plans renew automatically each billing period until cancelled. You can cancel anytime; cancellation takes effect at the end of the current period.
- Each plan includes a monthly AI-analysis allowance. Allowances exist because each analysis carries real compute cost; they reset each cycle and do not roll over.
- School plans include a stated number of seats and a pooled monthly allowance shared across the organization.
- We may change plan pricing or features prospectively with reasonable advance notice; changes do not apply retroactively to a period you have already paid for.
- Taxes may apply based on your location. Fees are non-refundable except where required by law.
5. Acceptable use
You agree not to:
- Misrepresent AI results as inspection, certification, or code-compliance findings;
- Upload content that is unlawful, infringing, or that you lack rights to;
- Upload images of people, or images unrelated to welding practice, for analysis;
- Probe, overload, scrape, or interfere with the Service or other users’ data;
- Share accounts, resell access, or circumvent plan limits or seat counts;
- Reverse engineer the Service except where the law permits it despite this term.
6. Your content
You keep ownership of the photos and other content you upload. You grant us a limited license to host, process (including AI processing), display, and back up that content solely to operate and improve the Service. Weld photos submitted for analysis are processed in memory and are not retained — see the Privacy Policy. If you submit work to a class, you also grant the class’s instructors and organization access as described in the Privacy Policy. You can delete your content, which ends the license except for backups that roll off on a schedule and records we must keep by law.
7. Our content and intellectual property
The Service, including all lessons, defect entries, certification-prep tracks, quiz questions, software, and design, is owned by Forge Nova Labs or its licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable license to use it for your own education (or your students’, on teaching plans). You may not copy, redistribute, or create derivative works from our content outside the Service.
8. Classes, instructors, and schools
Instructors and schools are responsible for how they use the Service in their programs, including grading decisions, supervision, and compliance with educational regulations that apply to them. Instructor feedback represents the instructor’s view, not ours. We provide tools; the teaching judgment is theirs.
9. Safety
Welding is inherently hazardous. The Service is study material — it is not a substitute for hands-on safety training, supervision, proper PPE, or your shop’s and employer’s safety rules. Always follow the safety requirements that apply where you weld. You use welding equipment at your own risk.
10. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI results are complete or correct, that the Service will be uninterrupted or error-free, or that content meets the requirements of any code, standard, employer, or testing body.
11. Limitation of liability
To the fullest extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill; (b) our total liability for claims relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim (or fifty US dollars if you paid nothing); and (c) we are not liable for welding outcomes, test results, employment decisions, or property damage or injury arising from welds — those depend on factors no photograph can capture and on decisions that belong to qualified people. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Termination
You can stop using the Service or delete your account at any time. We may suspend or terminate access for breach of these terms, abuse, or legal necessity — with notice where practicable. Sections that by their nature should survive (including 6, 7, 10, and 11) survive termination.
13. Changes to the Service or these terms
We improve the Service continuously and may add, change, or retire features. If we make material changes to these terms, we will notify you in the app or by email before they take effect; continued use after the effective date constitutes acceptance.
14. Governing law
These terms are governed by the laws of the jurisdiction in which Forge Nova Labs is organized, without regard to conflict-of-law rules, and disputes will be resolved in the courts of that jurisdiction unless applicable law gives you mandatory rights to a different venue.
